Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you (the "Client") and Artopus Creatives (OPC) Pvt. Ltd., operating under the brand name "Colormuse," with its principal place of business in Maharashtra, India. By accessing our website, placing a service order, or otherwise engaging with Colormuse, you agree to be bound by these Terms. If you do not agree to these Terms, you must refrain from using our services.

1. Acceptance of Terms

By accessing this website and/or availing any of our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you are requested not to proceed with our services or website.

3. Scope of Services

Colormuse provides bespoke creative services, including but not limited to:

  • Custom wedding logo design

  • Digital wardrobe planners (static and animated)

  • Digital wedding invitations (static and animated)

  • Custom digital wedding stationery

Each project is unique in nature and the scope, deliverables, and engagement structure may vary. All services are initiated based on customized client briefs.

4. Engagement and Payment Terms

  • Engagement is initiated upon receipt of 100% advance payment.

  • All fees are quoted in Indian Rupees (INR) and exclusive of applicable taxes. A Goods and Services Tax (GST) of 18% shall be levied on all invoices unless otherwise exempted.

  • Payments are processed through third-party payment gateway providers (e.g., Cashfree). Colormuse disclaims all liability for transactional failures caused by such third-party processors.

 
5. Timelines and Project Schedule

Due to the custom nature of design services, no fixed turnaround times are guaranteed. Estimated timelines will be provided to the Client based on the brief and complexity of the project. These are indicative only and not binding.

Delays due to Client unresponsiveness, force majeure, or change requests will affect overall delivery schedules.

​

Colormuse shall not be held responsible for any losses, damages, or liabilities arising from project delays.

6. Revisions and Change Requests

  • Each service engagement includes two (2) rounds of revisions, unless otherwise specified in writing.

  • Revision requests must be communicated clearly and within seven (7) calendar days of receipt of drafts.

  • Any revisions beyond the included scope or post-approval changes will incur additional charges.

 
7. Delivery of Work Product

  • Final deliverables are provided digitally through secure channels (e.g., WeTransfer) in standard final-use formats such as PDF or PNG.

  • Editable or source files (e.g., AI, PSD) are not included unless explicitly agreed in writing.

  • Files are considered delivered upon successful transmission. Any objections must be raised within 48 hours of receipt.

 
8. Intellectual Property and Usage Rights

  • All intellectual property rights remain vested in Colormuse until full payment has been received.

  • Clients are granted a limited, non-exclusive, non-transferable license to use the final design solely for personal and non-commercial use.

  • Colormuse retains the irrevocable right to display completed work in its portfolio, promotional materials, and marketing campaigns unless expressly restricted in writing.

 
9. Refunds, Cancellations, and Abandonment

  • All payments are strictly non-refundable, regardless of Client satisfaction, change in personal circumstances, or delivery timelines, as design work involves upfront creative labor, time, and resource commitment by our team.

  • Projects may be canceled by the Client at any time, but such cancellations do not warrant any refund.

  • Projects left unresponsive or inactive for more than fourteen (14) calendar days without formal closure will be considered abandoned and closed without refund.

 
10. Confidentiality and Data Protection

  • All information shared by the Client for the purpose of service execution will be treated as confidential.

  • Colormuse undertakes not to disclose, reproduce, or use such information beyond the scope of the project.

  • Colormuse follows reasonable data protection protocols but disclaims liability for third-party breaches or cyber incidents beyond its control.

 
11. Use of Third Parties

Colormuse reserves the right to delegate portions of the work to vetted third-party collaborators, including freelancers, vendors, or subcontractors. All such collaborations shall be governed by non-disclosure and confidentiality obligations consistent with these Terms.

 
12. Force Majeure

Neither party shall be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, internet outages, or governmental actions.

 
13. Limitation of Liability

In no event shall Colormuse or its directors, officers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or revenues, whether incurred directly or indirectly. Colormuse’s total aggregate liability shall not exceed the fees actually paid by the Client for the specific service.

 
14. Indemnification

The Client agrees to indemnify, defend, and hold harmless Colormuse, its officers, agents, and subcontractors from and against any and all claims, liabilities, losses, damages, expenses, and costs arising out of or related to the Client’s misuse of the services, breach of these Terms, or violation of applicable laws.

 
15. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of India. Any disputes, claims, or controversies arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Nagpur, Maharashtra, India.

16. Amendments and Severability

Colormuse reserves the right to amend or update these Terms at any time without prior notice. Continued use of services constitutes acceptance of any revised Terms.

If any provision of these Terms is found to be unlawful or unenforceable, such provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

17. Third-Party Links and External Sites

Colormuse’s website and communications may contain links to third-party websites. These links are provided solely for informational purposes. Colormuse is not responsible for the content, policies, or practices of any third-party website.
